An Ikeja High Court on Friday discharged and acquitted a fashion designer, Ifeanyi Igwe, who has spent four years in jail while the case of conspiracy and attempted robbery against him lasted.
According to the News Agency of Nigeria, Igwe breathed the air of freedom, after Justice Raliatu Adebiyi, found him not guilty.
The judge said Igwe’s acquittal followed the prosecution’s inability to prove its case against Igwe.
Adebiyi said, “The evidence of sole witness in the case, Sgt. Augustine Okodo, the Investigating Police Officer, gave no evidence of the fact that nothing was stolen, there was also no evidence from the alleged victim.
“The court finds that the defendant’s statement did not contain any admission of conspiracy.
“The prosecution failed to prove the charge of conspiracy beyond reasonable doubt. And the testimony of the IPO did not give any evidence that the defendant robbed one Abdullahi Salami.
“The statement of the defendant is at variance with the testimony of the IPO, the defendant had admitted in his statement that he had stolen a Bajaj motorcycle from Salami.
“This is at variance with the testimony of the IPO which was about the attempted robbery of a member of the public.
“The prosecution failed woefully to prove the charge of conspiracy and attempted robbery.The defendant is hereby discharged and acquitted of the charges.”
The prosecution led by Mrs.BukolaAkanni of the Office of the Public Defender, had alleged that on July 13, 2013, Igwe and an accomplice had attempted to rob a member of the public while on a motorcycle at Agoyi Junction, Isolo Road, Isolo, Lagos State.
“The robbery was foiled when their intended victim raised the alarm and in their attempt to escape, they were hit by a vehicle and apprehended,” the prosecutor said.
Meanwhile, a 40-year-old security guard has been arraigned before an Ikeja Chief Magistrates’ Court, Lagos for allegedly raping a 16-year-old girl.
The guard, SalisuYakubu, a resident of Chike Street, Ipaja, Lagos, allegedly raped the teenager on December 10 at the accused residence.
The prosecutor, Inspector Clifford Ogu,said that the 16-year-old girl was sent on an errand by her mother when the accused, who lived on the same street, allegedly ambushed her.
“The accused covered her mouth and carried her to his room where he raped her.”
Ogu said that the girl cried till she got home and narrated her ordeal to her mother, who reported the case at the police station.
The prosecutor said that the offence contravened Section 259 of the Criminal Law of Lagos State, 2015.
The accused, however, pleaded not guilty to the charge.
Chief MagistrateTaiwoAkanni granted the accused N200,000 bail with two sureties in like sum.
The case was later adjourned till January 31, 2018 for mention.
